Terms of service
These Terms and Conditions cover our Monthly Grow Boxes first, then gifts, then our other one-off products - Gardening Gear, Big Veg boxes, Special Editions, fruit bushes and seeds.
They apply to everything you buy from us at www.potgang.co.uk. By placing an order you're agreeing to them, so it's worth a read. Nothing in here takes away the rights you have by law.
Who we are, and who we sell to
1. We're Pot Gang Ltd, company number 12685761, registered at Unit 407, Bon Marche Centre, 241-251 Ferndale Road, London, SW9 8BJ. You can reach us any time at gang@potgang.co.uk.
2. You need to be 18 or over to order from us.
3. We deliver to the UK, the Channel Islands and the Isle of Man. We don't currently deliver anywhere else.
4. Your order is an offer to buy from us. There's a contract between us once we've sent you an order confirmation. Very occasionally we might not be able to accept an order - if something's out of stock, if we can't deliver to your address, or if we spot a pricing error - and if that happens we'll tell you and refund you in full.
Monthly Grow Boxes
5. A monthly grow box is a box of seeds, pots, compost and grow guides, built around what's worth planting that month. You can buy one as a rolling monthly subscription, or as a one-off if you'd rather just try it. Clauses 5 to 8 and 11 to 14 apply however you bought it. Clauses 9, 10 and 15 to 19 only apply if you've subscribed.
6. The contents change every month - that's the whole point of them. We publish what's coming, but growing seasons and suppliers being suppliers, we may occasionally swap a variety for something comparable. If we do, it'll be a like-for-like swap and we'll tell you what's in the box.
7. Boxes come in a few shapes - the full box, the same box with saucers added, one without pots, and a seeds-and-guides-only version - and they're priced differently. The price of the box you've chosen, and the delivery charge, are both shown at checkout before you pay. Delivery is charged on top of the box price. Pre-paid subscriptions work out cheaper per box.
8. If you're subscribed and we change the price of your subscription, we'll email you before it takes effect and you'll have the chance to cancel or change your plan first. We'll never change what you pay without telling you.
Paying for a subscription
9. Your first payment is taken when you place your order. After that, your subscription renews monthly and we take payment on the same date each month. That payment is what generates your next box.
10. If a payment doesn't go through, we'll try again a few times over the following days and email you a secure link to update your card. We won't cancel your subscription because of a failed payment, but your box won't go out until the payment clears.
When your box is made up and sent
11. Orders are put together automatically early each morning. If your box is one we're currently sending out, it goes to our warehouse the same morning and is normally dispatched that day. If you've ordered next month's box, it's dispatched on the 1st of that month - it sometimes goes a bit sooner, but the 1st is what we commit to.
12. When you first sign up you can choose to start on the box we're currently sending, either of the two before it, or next month's. So if you get a box that isn't the current month's, that's why - it's the one you picked.
13. Delivery is by a mix of Royal Mail, Yodel and our own drivers, depending on where you are and how busy we are. Our standard service is tracked and normally 2-3 working days from dispatch. Where a faster tracked service is offered you'll see it at checkout, normally 1-2 working days from dispatch. Those are the courier's timings rather than a guarantee from us, and they can stretch a bit at busy times or in bad weather.
14. We can't reliably arrange for a parcel to be left in a particular spot. Delivery instructions added to a label aren't guaranteed to be seen by the driver, so we'd rather be straight with you than promise something that might not happen. A note on your own door or gate for the driver genuinely works better.
Skipping, pausing and cancelling a subscription
15. You can skip a box, pause, or cancel whenever you like. Email us at gang@potgang.co.uk, message us, or manage it yourself in your account - follow the 'create account' instructions in your welcome email and it'll sync with your subscription.
16. The moment that always works is before your next payment date. Once a payment has gone through, your box is made up and sent to our warehouse the same morning, and from that point we may not be able to stop it. We'll always try - if it hasn't been picked yet we can usually catch it, once it's been packed it gets harder, and once it's left the building it's gone. So if you know you want to skip or stop, a heads-up before your payment date makes it easy for everyone.
17. Pausing: we can pause your subscription for up to six months, and it'll start itself back up on the date you choose. We'll give you a heads-up before it does, so it never restarts without warning. If you want longer than six months, we'll just push your next box out to a date you pick instead - your subscription stays active and nothing comes or gets charged until then.
18. Cancelling stops all future boxes and payments. If you want to come back later, you're always welcome - you'd just sign up again on the website.
19. Pre-paid subscriptions can be cancelled at any time, and we won't take any further payment. Because they're bought as a discounted block up front, we don't refund the remaining boxes as a matter of course - but if something's gone wrong or your circumstances have changed, talk to us. We'd rather sort it than hide behind this clause.
Your account and your details
20. We can only make changes to an account at the request of the account holder. If someone bought you a box or a subscription as a gift, we can help you with your own parcel, but anything to do with the account, the plan or the payment has to come from whoever set it up. It's not us being difficult - it's their account and their card.
21. If you move house or need to change a delivery address, tell us as soon as you can. Your address needs to be updated before your box is made up in the morning, otherwise it'll go to the old one. Let us know whether you mean just the next box, everything from now on, or both, and we'll make sure it's right.
Gift subscriptions and gift cards
22. Gift subscriptions are pre-paid for a set number of boxes and don't automatically renew. The person who bought it manages it. If you're the lucky recipient and something's up with a delivery, get in touch and we'll help with your parcel.
23. Gift cards are redeemed at checkout against a subscription. They can't be exchanged for cash, and we can't reissue one that's been lost, so keep the code safe.
Other one-off products
24. Alongside the grow boxes we sell Gardening Gear (greenhouses, pots, saucers, compost, planners and the like), Big Veg boxes, Special Edition boxes, fruit bushes and individual seed packs. These are one-off purchases, not subscriptions, and they're covered by our Refunds and Returns policy.
25. Some things have limited stock and we may run out. We do our best to show colours and images accurately, but we can't guarantee your screen shows them exactly as they are.
26. Prices and product descriptions can change, and we may stop selling something at any time. Any change applies to orders placed after it, never to an order you've already paid for.
Pot Passport
27. The Pot Passport is our loyalty card. Fill the six spots, send it in, and we'll apply your reward to your subscription once we've had a look at it. It has no cash value, can't be exchanged for money, and we may change or end the scheme - if we do, we'll honour any passport already completed and sent to us.
Discount codes and playing fair
28. We sometimes offer discount codes. Unless a code says otherwise, it's one use per delivery address, can't be combined with other offers, and can't be applied to an order you've already placed. If someone's clearly working the system, we reserve the right to cancel the order or close the account.
29. Please don't copy our guides, photos, videos or artwork without asking us first. We make them ourselves and we're quite fond of them.
Growing, and what we're responsible for
30. We try to make growing from seed as straightforward as we can, with simple guides, how-to videos and well-chosen seeds, compost and pots. But weather happens, slugs happen, and everyone follows instructions a bit differently. So we can't promise your veg will thrive, and we're not responsible for the ultimate success of your growing.
31. That's about the growing, not about the stuff. If something we send you is faulty, damaged, missing or not what was described, that's on us - tell us and we'll put it right. Nothing in clause 30 affects your legal rights when goods aren't what they should be.
32. We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care. We're not responsible for loss or damage that isn't foreseeable, and unless clause 33 says otherwise, our liability to you for any order is limited to what you paid for it.
33. We don't limit or exclude our liability in any way that the law doesn't allow. That includes liability for death or personal injury caused by our negligence, for fraud, or under your legal rights as a consumer in relation to goods that are faulty, not as described, or not fit for purpose.
Your data
34. We look after your data in line with UK data protection law. Our Privacy Policy explains what we collect and why. You can ask us for a copy of the data we hold on you, or ask us to delete it, by emailing gang@potgang.co.uk - we'll respond within a month. Some records, like order and VAT history, we're required to keep by law even after an account is closed.
35. Opting out of our marketing emails or messages won't stop the service emails you need, like order confirmations and dispatch notices.
The last bits
36. We may update these terms from time to time. The version on this page is the one that applies, and if we make a change that materially affects an active subscription we'll email you about it first.
37. If something's gone wrong, please tell us at gang@potgang.co.uk and we'll do our best to sort it. If we can't reach a resolution between us, you may be able to take it to an alternative dispute resolution provider, and you can always ask the Citizens Advice consumer service for guidance.
38. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction - although if you live in Scotland or Northern Ireland you can bring proceedings in your own courts.
